3 tips for dealing with a lowball car accident settlement offer

Getting in a car accident can be a devastating financial blow. Handling the aftermath of your auto collision may be confusing and frustrating, especially when dealing with the insurance company representing the negligent driver. You understandably want to resolve everything as quickly as you can, but be careful when it comes to accepting the initial settlement offer.

The insurance adjuster will likely try to give you the least amount of compensation possible. He or she may do this in hopes that you are eager to get past the incident so you will accept a lowball offer. However, here are some tips for rejecting an insufficient offer and negotiating a better one

1. Get an attorney

Before you try to do anything yourself, get help from a lawyer. Navigating the complexities of insurance offers can leave you at a disadvantage. Having an attorney on your side will not only give you the counsel you need to move forward, but it will also show the insurance company you are serious about getting what you deserve. 

2. Calculate your compensation

Your attorney will assist you in thoroughly calculating the compensation you need. Consider all monetary and noneconomic damages, including medical expenses, vehicle repairs and mental anguish. If you have not collected repair estimates for your car or gathered your medical records, do so now. 

3. Be assertive

Insurance companies are notorious for delaying settlements and ignoring phone calls in an attempt to stave off claimants. Get a lawyer who will fight against these tactics and make sure everything gets resolved in a timely manner. Consider whether you are willing to take your case to trial or file a personal injury lawsuit on top of filing the insurance claim.
